Terms of Service

1. Services Provided

Mount Joy Home Services Inc. provides the following professional inspection services in New York State and Eastern Pennsylvania:

• Residential home inspection
• Septic system inspection (camera-guided sewer scope)
• Radon gas testing
• Well water bacteria testing

All inspections are performed by a licensed home inspector. Services are available as standalone or bundled offerings as described on our website.

2. Booking and Scheduling

Inspection appointments are confirmed via telephone or email following your inquiry. An inspection is considered scheduled once you receive written or verbal confirmation from us. We reserve the right to reschedule due to weather, property access issues, or other circumstances outside our control, with reasonable notice to you.

Cancellations made less than 24 hours before the scheduled inspection may be subject to a cancellation fee. Please contact us as early as possible if you need to reschedule.

3. Payment

Payment is due at the time of service unless otherwise agreed in writing. We accept cash, check, and major credit cards. Inspection reports will be delivered after payment is received.

All listed prices are in U.S. dollars. Bundle pricing applies only when services are booked and performed together on the same visit. Pricing is subject to change; the price confirmed at booking applies to your appointment.

4. Inspection Report

Upon completion of the inspection, you will receive a written report describing the condition of the inspected property at the time of the inspection. The report is prepared for the sole use of the client named in the agreement and should not be relied upon by third parties.

The inspection report reflects conditions visible and accessible at the time of inspection. It does not constitute a warranty, guarantee, or certification of any kind regarding the property.

5. Scope and Limitations

Our home inspections follow the Standards of Practice established by the American Society of Home Inspectors (ASHI). We inspect components that are:

• Safely and readily accessible
• Visible without moving personal property, furniture, or equipment
• Present at the time of inspection

We do not perform invasive or destructive testing. We do not inspect components that are concealed, buried, or inaccessible. Conditions discovered after the inspection that were concealed or inaccessible are not covered by this agreement.

6. Limitation of Liability

Our liability for any claim arising from an inspection is limited to the fee paid for that inspection. We are not liable for consequential, incidental, or punitive damages of any kind.

This limitation applies regardless of the theory of liability, including negligence, breach of contract, or otherwise. If you disagree with our findings, you must notify us in writing within 14 days of receiving the report and provide reasonable access for re-inspection before any remediation work is performed.

7. Water and Radon Testing

Water samples and radon devices are collected by us and submitted to a state-certified laboratory for analysis. Laboratory results are provided as received. We do not alter or interpret laboratory findings beyond providing plain-language explanations. Turnaround times stated on our website are estimates provided by the laboratory and are not guaranteed.

Radon tests require closed-house conditions for a minimum of 12 hours prior to and during the test period. If closed-house conditions are not maintained, results may be invalid and a re-test may be required at additional cost.

8. Client Responsibilities

By booking an inspection, you agree to:

• Ensure the property is accessible at the scheduled time
• Provide accurate property information (address, size, age, well/septic status)
• Ensure utilities are active at the time of inspection
• Maintain closed-house conditions if radon testing is included
• Not perform remediation work on items noted in the report until we have had the opportunity to re-inspect, if requested

9. Intellectual Property

Inspection reports generated by us remain our intellectual property until payment is received in full. Once paid, the client named in the agreement is granted a non-exclusive license to use the report for the purpose of the real estate transaction. Reports may not be shared publicly, published, or used for commercial purposes without our written consent.

10. Governing Law

These Terms of Service are governed by the laws of the State of New York. Any disputes arising from our services shall be resolved in the courts of the State of New York, County of Ulster, unless both parties agree to alternative dispute resolution.

11. Changes to These Terms

We may update these Terms of Service from time to time. The current version will always be posted on this page with an updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the revised terms.
